By accessing or engaging with services provided by SCALE UP INC (also doing business as Strategic Campaign Analysts Leading Elections with Unbiased Polls), you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to any part of these terms, you may not use our services. Continued engagement with SCALE UP INC following any modification to these terms constitutes acceptance of the revised version.
SCALE UP INC provides public opinion polling, electoral analytics, market research, expert interviews, business delegation coordination, interpretation services, and related professional services to government bodies, private organizations, and international clients. The specific scope of deliverables, timelines, and fees for each engagement is defined in a separate service proposal, contract, or letter of agreement issued prior to commencement of work.
Clients must provide accurate, complete, and lawful information necessary for the execution of commissioned services. Clients assume full responsibility for how research outputs, data, and reports are used, shared, or publicly disseminated. SCALE UP INC bears no liability for decisions made based on misapplied, selectively presented, or out-of-context research findings. Clients must not use SCALE UP INC's work product in any manner that violates applicable law or infringes on the rights of third parties.
All methodologies, analytical frameworks, survey instruments, proprietary tools, templates, and deliverables developed by SCALE UP INC remain our intellectual property unless expressly transferred in writing via a separate agreement. Upon full payment, clients are granted a non-exclusive, non-transferable license to use delivered outputs solely for the purpose of the commissioned engagement. Reproduction, resale, sublicensing, or redistribution of SCALE UP INC's work product requires prior written consent.
SCALE UP INC treats all client information, engagement details, and raw respondent data as strictly confidential. We comply with Republic Act No. 10173 (Data Privacy Act of 2012) and maintain data protection protocols consistent with ISO-certified quality standards. Client information is never shared, sold, or disclosed to third parties without express written consent, except where required by applicable Philippine law or court order. Respondent identities are anonymized in all published outputs.
Service fees are agreed upon in the applicable proposal or contract prior to engagement. Unless otherwise specified, invoices are payable within fifteen (15) calendar days of issuance. Invoices outstanding beyond thirty (30) days may result in suspension of ongoing services. Fees are denominated in Philippine Pesos (PHP) unless the service agreement explicitly states otherwise. SCALE UP INC reserves the right to require partial advance payment for new or large-scale engagements.
All research is conducted using validated scientific methods, statistically sound sampling approaches, and industry-standard quality protocols. Research findings represent data collected at a specific point in time and are subject to change as conditions evolve. SCALE UP INC makes no warranties — express or implied — regarding electoral outcomes, market performance, business results, consumer behavior, or any future events. Our findings are intended to inform professional decision-making, not to replace expert judgment.
Our services may reference, integrate, or depend upon third-party platforms, data sources, survey tools, or software. SCALE UP INC is not responsible for the accuracy, availability, security, or terms of service of any third-party provider. References or hyperlinks to external resources are provided for informational purposes only and do not constitute an endorsement. Clients who interact with third-party platforms do so under those platforms' own terms.
To the maximum extent permitted by applicable law, SCALE UP INC shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of revenue, loss of data, or reputational harm — arising from the use of our services, reports, or data. Our aggregate liability to any client shall not exceed the total fees paid to SCALE UP INC by that client in the three (3) calendar months immediately preceding the event giving rise to the claim.
These Terms of Service are governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute, controversy, or claim arising from these terms or from any engagement with SCALE UP INC shall be subject to the exclusive jurisdiction of the competent courts of Makati City, Philippines. International clients may request alternative dispute resolution through mutually agreed arbitration prior to initiating court proceedings.
SCALE UP INC reserves the right to update or amend these Terms of Service at any time without prior notice. Changes become effective upon publication on this page.
